General Terms and Conditions (T&Cs)

1. Scope of Application of the T&Cs & Treatment Agreement

1a) These T&Cs govern the business relationship between Ms. Dipl.-Psych. Stephanie Ferretti, hereinafter referred to as the “Psychologist,” and the client, as a treatment agreement, unless otherwise agreed in writing between the parties.

1b) The treatment agreement comes into effect when the client accepts the general offer of the Psychologist through implied action and contacts the Psychologist for consultation, or coaching.

1c) The Psychologist reserves the right to refuse a treatment agreement without giving reasons, particularly if a necessary trust-based relationship cannot be expected, if the issue falls outside her specialization or cannot be treated for legal reasons, or if it could cause a conflict of conscience. In such cases, the Psychologist retains the right to remuneration for any services already provided, including consultations.

1d) The Psychologist may use methods that are not recognized by conventional medicine or are not scientifically explainable. These methods are generally not causally or functionally explicable and are not target-oriented. No promise or guarantee of success can be made. If the client objects to such methods, this must be declared to the Psychologist in writing before treatment begins.

2. Client Participation

Clients must follow agreed behavioral instructions, as otherwise, treatment success cannot be expected. Clients are encouraged to actively participate in therapy planning to explore alternative treatment options. The Psychologist may discontinue treatment if the necessary trust is no longer present, especially if the client denies consultation content, provides inaccurate or incomplete information.

3. Appointment Scheduling & Psychologist Fees

3a) The Psychologist is entitled to a fee for her services. Booking an appointment is a paid service and implies a payment obligation. Fees vary depending on the type of session.

3b) Health insurance or supplementary insurance usually does not reimburse the invoice amount.

3c) The initial telephone or video consultation is free and serves to answer questions and provide an initial introduction before booking an appointment.

3d) The fee must be paid upon booking to confirm the appointment. Further payment arrangements are discussed and agreed upon individually with the client in writing.

3e) All fees must be paid via bank transfer. The timing of payment is agreed individually. Invoices are emailed to the client upon request.

4. Cancellation & Payment Policies

The Psychologist works strictly by appointment—there are no open office hours. Individual time slots are reserved for each client. Therefore, replacing a canceled appointment with another client on short notice is not possible.

4a) Appointment Cancellations and Changes
Appointments can be canceled or rescheduled free of charge up to 24 hours in advance via email or phone.
Cancellations made less than 24 hours before the appointment or no-shows without prior notice will be charged in full.

4b) Early Termination of Therapy Packages
If a client discontinues coaching/treatment before completing a prepaid package, all associated discounts and price reductions are voided. Sessions already conducted may be recalculated at the regular rate.
If a client fully withdraws from coaching/treatment and cancels future appointments, an administrative fee may apply.

4c) Late Payment Fee
If payment is not made by the agreed due date, a late fee of €1 per day will be charged until full payment is received.

4d) Exceptions
In cases of medical emergencies or other unforeseeable events, the Psychologist may waive cancellation or late fees at her discretion.

4e) Refunds
Prepaid sessions may be refunded, minus any applicable cancellation or administrative fees, if canceled more than 24 hours in advance.

4f) Cancellations by the Practice
To allow for quick contact in case of Psychologist cancellations, clients are required to provide a reachable phone number (e.g., mobile) and email address when booking. The next available replacement appointment will be offered.

4g) Termination of the Agreement by the Practice
The Psychologist may only terminate the agreement without notice for a significant reason. Such reasons include: the client provides false or incomplete information, the Psychologist cannot or may not treat the client due to specialization or legal restrictions, or if continuing would create a conflict of conscience.
Any fees already incurred at the time of termination remain unaffected.

5. Punctuality & Delays

If the client arrives more than 15 minutes late, the session cannot be conducted as scheduled. A cancellation fee may be charged, which may be partially credited toward a rescheduled session.

6. Invoicing

For invoicing, the client provides the Psychologist with the necessary personal information (e.g., full name, address, tax number). Upon request, the client receives an invoice via email for the booked services.

7. Disputes

Disagreements arising from the treatment agreement or T&Cs should be resolved amicably. It is recommended to initially present objections, differing opinions, or complaints verbally and, if necessary, in writing.

8. Severability Clause

If individual provisions of the treatment agreement or T&Cs are invalid or become invalid, the validity of the agreement as a whole remains unaffected. The invalid provision is to be replaced by a provision that best reflects the intent and purpose of the original.

9. Confidentiality

The Psychologist agrees to treat all information received in the course of her services as strictly confidential and will not disclose it to third parties unless legally obligated to do so.

10. Data Protection

The collection and processing of personal data is carried out in accordance with the website’s privacy policy. By using the website and services, the client agrees to the processing of their data.

11. Right of Withdrawal

Clients have the right to withdraw from the contract within 14 days without stating a reason. The withdrawal must be submitted in writing via email to: info@emetophobietherapie.de
If services have already been rendered, the right of withdrawal no longer applies.

12. Final Provisions

If individual provisions of these T&Cs are wholly or partially invalid, the remaining provisions remain unaffected. Invalid provisions will be replaced by statutory regulations. Changes or additions to the T&Cs must be made in writing.

13. Jurisdiction

The place of jurisdiction is the tax residence of the Psychologist: Las Palmas de Gran Canaria, Spain.
